Secure Your Legacy with a Revocable Living Trust in Central Florida
-
A Florida Revocable Living Trust is a legal document that allows you to manage your assets during your lifetime and pass them to heirs without the delay or expense of probate court. In 2026, these trusts are the gold standard for Central Florida homeowners looking to maintain privacy, bypass the 3% statutory probate fee, and ensure a seamless transition of legacy.
For many families in Winter Garden, Clermont, and The Villages, the goal of estate planning is simple: ensure your loved ones are provided for without the stress, cost, and public exposure of Florida Probate court. Working with an estate planning attorney to establish a Revocable Living Trust is often the most effective way to achieve that lasting peace of mind.
At Marissa Petillo Law, we specialize in crafting personalized trusts that protect families across Orange and Lake Counties. Whether you are raising a young family in Windermere or enjoying retirement in The Villages, our law firm ensures your wishes are followed exactly as you intended through a strategy tailored to your specific financial and legacy goals.
The Benefits of a Florida Revocable Living Trust
A trust is a powerful legal tool that allows you to maintain total control over your assets during your lifetime while providing a seamless transition for your heirs. Central Florida families choose this path to achieve four critical goals:
Bypass Probate
Inheritances are accessed in weeks, avoiding the 6–12 month court process in Orange County.
Family Privacy
Unlike a Will, a Trust remains a private document and does not become public record.
Incapacity Protection
Avoid court-appointed guardianship if you ever become unable to manage your affairs.
Total Control
Retain the right to manage, sell, or alter your assets at any time during your life.
Serving Our Local Communities
We understand that every neighborhood in Central Florida has unique needs. Marissa Petillo Law provides tailored legal expertise across the region:
Winter Garden & Windermere
Protecting primary residences and ensuring smooth transitions for local business owners.
Clermont & Ocoee
Managing real estate and investment portfolios with clear, enforceable trust structures.
The Villages
Specializing in legacy planning and asset protection to simplify estates for your heirs.
The "Funding" Difference
A trust is only effective if it is properly "funded." This means your assets—like your home in Lake County or accounts in Orange County—must be correctly retitled into the name of the trust. We don't just hand you a stack of papers; we guide you through the funding process to ensure your plan actually works when your family needs it most.
A Complete Safety Net
A Revocable Living Trust is the centerpiece of a comprehensive plan. To ensure your protection is 360-degrees, we pair your trust with these essential documents:
| Protection Component | What it Protects |
|---|---|
| Durable Power of Attorney | Your financial decisions and assets during your lifetime. |
| Healthcare Surrogate | Designates someone to manage your medical care and HIPAA access. |
| Living Will | Your specific end-of-life medical wishes. |

Our easy, 4-step Process
-

Peace of Mind Planning Session
The first step is to attend your Peace of Mind Planning Session. You’ll fill out a secure online questionnaire (“Family Profile”) before we meet so we can make the best use of our time together. At this Zoom session, you’ll learn all about your options and our flat fees. When you are ready to move forward, we’ll email you an engagement letter and invoice, both of which can be executed online.
-

Estate Plan Design Session
Next is your Estate Plan Design Meeting. We’ll roll up our sleeves and design your trust and other estate planning documents, working off the information you provided in your Family Profile.
-

Document Review
After this session, I’ll draft your documents, and send a copy for your review about two weeks later. At this time we will schedule a document review meeting where we can go through the documents together and I will answer any questions you may have. We’ll then make any changes or updates you’d like to make. When everything is good to go, we’ll coordinate an in-person Signing Ceremony.
-

Signing Ceremony
Your Signing Ceremony is where you’ll sign your documents with the proper legal formalities, in front of two witnesses and a notary. We can have this session in person or virtually via Zoom. Following execution of the documents, we are available for free, unlimited lifetime consultations regarding your estate plan.
